Liability In Left Turn Accidents
According to the Association for Safe International Road Travel, over 37,000 people are killed every year in car accidents across the United States. In nearly 94% of these accidents, some amount of human error is involved. This is particularly true with drivers making left-hand turns. Drivers making left turns are often distracted as they are looking out for pedestrians as well as oncoming traffic. According to California Vehicle Code 21801:
“The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
Drivers that are making left turns before an accident will likely be found at fault. This is generally true unless the driver making the left turn had a green arrow. The family of a victim that died in a car accident may be able to seek justice through California Vehicle Code 377.60. Damages in a civil claim can help a victims next of kin recover for emotional trauma, funeral expenses and pain and suffering. A wrongful death attorney can investigate all of the facts of your case and let you know what your legal rights are.
