ENCINO, CALIFORNIA (June 24, 2019) – A bicyclist was critically injured after being involved in a car accident with an LAPD motorcycle officer by the Sepulveda Dam Recreation Area by West Burbank Boulevard.

Firefighters and paramedics rushed to the scene in order to help both victims. The bicyclist was transported to a trauma center in critical condition in order to receive treatment. 

The cause of the Encino LAPD motorcycle accident with the bicyclist remains ongoing at this time. 

Liability In LAPD Motorcycle Accidents

Generally speaking, LAPD officers and other emergency responders have a great deal of immunity from civil claims. According to California Vehicle Code 21055, “The driver of an authorized emergency vehicle is exempt from Chapter 2 …. If the vehicle is being driven in response to an emergency call or while engaged in rescue operations or is being used in the immediate pursuit of an actual or suspected violator of the law or is responding to, but not returning from, a fire alarm.” However, police officers and other emergency responders must warn other drivers about their presence. 

According to section (b) of the statute, police officers and emergency responders must sound “a siren as may be reasonably necessary and the vehicle displays a lighted red lamp visible from the front as a warning to other drivers and pedestrians.” If police officers fail to use their lights and sirens they are held to the same standard as everyone else. They will not be immune from civil suit and must obey all relevant traffic laws. Faster moving vehicles like motorcycles must take caution to avoid hitting bicyclists.
