EL SOBRANTE, CALIFORNIA (February 9, 2019) – A 52-year-old man identified as Aaron De Muynck has died in a car accident while riding his bicycle by San Pablo Dam Road.

California Highway Patrol are saying that the accident took place on February 2 around 1:15 a.m. Aaron De Muynck was taken to the John Muir Medical Center in Walnut Creek in order to receive treatment for his injuries.

He was later pronounced dead at the hospital. The car that hit the victim has been described as a 1999 silver Toyota. An investigation into the accident remains ongoing at this time.

Liability In Bicycle Accidents

Drivers must watch out for bicyclists and yield the right of way as appropriate. According to the California Vehicle Code 21200 (a), “A person riding a bicycle or operating a pedicab upon a highway has all the rights and is subject to all the provisions applicable to the driver of a vehicle by this division, including, but not limited to, provisions concerning driving under the influence of alcoholic beverages or drugs.”

In addition to negligence on the part of a driver, there may also be liability on the part of a city for a bicycle accident. According to California Government Code 830.8, “A public entity may be liable for accidents approximately caused by its failure to provide a signal, sign, marking or device to warn of a dangerous condition which endangers the safe movement of traffic and which would not be reasonably apparent to, and would not have been anticipated by, a person exercising due care.” For example, a bicycle lane may be too narrow or end abruptly leaving cyclists in peril.

The family of a victim that dies in a bicycle accident can seek justice by filing a claim under California’s Code of Civil Procedure 377.60. A bicycle accident attorney can investigate your claim free of charge and let you know what your options are. There are statute of limitations associated with being able to file a claim. Failing to act within those limitations can result in a forfeiture of your rights.
