Liability In Bicycle Accidents
Drivers must watch out for bicyclists and yield the right of way as appropriate. According to the California Vehicle Code 21200 (a), “A person riding a bicycle or operating a pedicab upon a highway has all the rights and is subject to all the provisions applicable to the driver of a vehicle by this division, including, but not limited to, provisions concerning driving under the influence of alcoholic beverages or drugs.”
In addition to negligence on the part of a driver, there may also be liability on the part of a city for a bicycle accident. According to California Government Code 830.8, “A public entity may be liable for accidents approximately caused by its failure to provide a signal, sign, marking or device to warn of a dangerous condition which endangers the safe movement of traffic and which would not be reasonably apparent to, and would not have been anticipated by, a person exercising due care.” For example, a bicycle lane may be too narrow or end abruptly leaving cyclists in peril.
