Liability In Pedestrian Accidents
According to the Centers For Disease Control, “almost 129,000 pedestrians were treated in emergency departments for non-fatal crash-related injuries in 2015. Pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash on each trip.” There are a number of reasons why pedestrian accidents take place.
- Driver fatigue
- Driver distraction
Driver’s have a legal obligation to yield the right of way to pedestrians in lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.”
Any person that is injured in a pedestrian accident may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A pedestrian accident attorney can examine all of the facts of your case free of cost and let you know what your legal options are.
