Liability In Wall Collapses At Construction Sites
Wall collapses are one of the leading causes of injury and death at construction sites. Retaining walls collapse for typically two different reasons. Walls degrade over time and lose their structural integrity. This can be due to weather or other environmental factors. Retaining walls may also collapse due to the deterioration of the soil around the wall. This may occur due to rain and usually takes place where there is a lack of adequate draining around the wall. Adequate draining systems will typically include gravel, drainage pipes and weep holes through the wall itself.
If a worker is injured or killed in a wall collapse accident in California they or their family will have the ability to file a worker’s compensation claim. A wall collapse can leave a worker with serious injuries including broken bones, spinal cord injuries and traumatic brain injuries. It’s important to document your injuries and let a doctor know that you were hurt on the job. Depending on the specific facts of any case, a worker or their family may have the ability to file a third party negligence claim.
A third party claim may be possible if a construction worker was injured due to the negligence of a company separate from their employer. Construction sites are usually made up of a blend of workers from separate companies who must accomplish a common goal. If one company poorly designed a retaining wall and that collapses and kills another company’s worker a third party claim may be possible. It’s always a good idea to seek the legal guidance of an experienced wrongful death attorney after a construction site accident. An attorney can help make sure you are taken care of through the workers compensation system and also check for third party negligence.
