12-Year-Old Boy Seriously Injured In Boating Accident By The Emerald Cove Resort On The Parker Strip In Earp
EARP, CALIFORNIA (May 29, 2019) – A 12-year-old boy sustained a serious injury in a boating accident at the Emerald Cove Resort on Parker Strip.
Authorities are saying that the boy was tubing with his family on the lake when he was hit by the boat. The 12-year-old boy was being pulled by his father near the Emerald Cove Resort.
Paramedics rushed to the scene of the accident in order to help the boy. He sustained a serious leg injury after being hit by the boats propeller.
An investigation into the cause of the boat accident remains ongoing at this time.
Liability In Boating Accidents
According to one report by SB Sailing News, “In 2015, the Coast Guard counted 4,158 accidents that involved 626 deaths, 2,613 injuries and approximately $42 million dollars of damage to property as a result of recreational boating accidents.” The vast majority of boat accidents are due to human error.
For example, a number of boaters speed and hit pedestrians in the water. Despite what many people think, there are “right of way” laws regarding boats. According to the National Maritime College:
- “The vessel which has the wind on its starboard (right) side has the right of way. The vessel which has the wind on its port (left) side must give way.”
- “When both boats have the wind on the same side the windward (upwind) boat has to give way.”
- “If you meet head on, both vessels must turn to starboard. (right)”
Any person that is injured in a boating accident may have legal recourse through a bodily injury claim. Victims will be entitled to lost wages, medical bills and pain and suffering. A personal injury attorney can investigate all of the facts of your case and let you know what your options are. There are, however, statute of limitations associated with being able to pursue a claim, so it’s important to act quickly.
