DOES IT TAKE A LAWSUIT TO SETTLE A CASE?

May 14, 2015

When you think about hiring a personal injury attorney in Los Angeles to represent you in your accident claim, you probably imagine dramatic courtroom scenes and shocking last-minute evidence revelations. We find that many of our clients are worried about having to go into a courtroom and face a judge or jury, based largely on the impression television and movies have created regarding how lawsuits and other proceedings actually work. Luckily, working through a lawsuit isn’t nearly as intimidating or difficult as you might think, and the large majority of claims are settled out of court without the need for an actual suit to be filed.

Settling Your Case

Unless you’re involved in a particularly tricky case where no clear fault has been established, your case will almost certainly be settled out of court. Most of these settlements are about on par with the value of the lawsuit — insurance companies know when they’re going to lose in court, so they try to resolve meritorious cases well before then. Therefore, although we are trial lawyers and we prepare every case as if we are going to trial, we also put significant effort into pre-trial settlement.

Settlements are just as legally binding as a court-ordered judgment. Once a settlement has been agreed upon, you are entitled to the full amount. West Coast Trial Lawyers works hard to resolve personal injury cases in your favor as quickly and efficiently as possible. We know you need your money as soon as possible and don’t want to wait for a trial that doesn’t actually need to happen.
