DESCANSO, CALIFORNIA (March 20, 2019) – A 56-year-old man has tragically died in a motorcycle accident on State Route 79 after a pickup truck made a left turn.
California Highway Patrol are saying that the accident took place around 4:25 a.m. near Olde Highway 80. Authorities are saying that the pickup truck driver was stopped at a stop sign before making a left turn into the path of the victim.
The motorcyclist attempted to lay his vehicle down in order to avoid the collision but he was still hit. Despite life-saving efforts he was later pronounced dead due to his injuries.
Liability In Motorcycle Accidents
Drivers are supposed to operate their vehicles in a reasonably safe manner in order to avoid accidents. A number of motorcyclists are killed every year when drivers make dangerous left turns. According to the California Vehicle Code 21801:
“The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
In short, drivers are supposed to wait until it is safe to turn and yield the right of way to oncoming vehicles. Drivers that fail to do this may face civil liability in the event of a crash. A victim’s next of kin will have recourse through a wrongful death claim. A wrongful death lawyer can examine the facts of your case free of cost and tell you what your options are.
