COSTA MESA, CALIFORNIA (January 30, 2019) – A 24-year-old pedestrian was seriously injured after he was hit by an ambulance by the intersection of Newport Boulevard and 19th Street.
Costa Mesa police officials are saying that the accident took place just after 4:00 a.m. A patient was in the ambulance at the time of the accident, but it remains unclear if they were injured.
The pedestrian was transported to the hospital with serious injuries. An investigation into the ambulance accident remains ongoing at this point.
Liability in Ambulance Accidents
Ambulance drivers have a responsibility to drive in a reasonably safe manner and take steps to avoid causing accidents. According to the California Civil Code 815.2, “A public entity is liable for injury proximately caused by an act or omission of an employee of the public entity within the scope of his employment if the act or omission would, apart from this section, have given rise to a cause of action against that employee or his personal representative.”
Liability in an ambulance accident will normally hinge on whether or not an ambulance has its lights and sirens on. Ambulances, police cars, firefighters and other emergency vehicles have a great deal of immunity when they are responding to an emergency situation with their lights and sirens on. A wrongful death attorney can examine the specific facts of your case and let you know if you have a claim that can be pursued.
