Liability In Accidents With Police Vehicles
A city may face civil liability for a car accident involving a negligent police officer. According to the California Vehicle Code 17001, “A public entity is liable for death or injury to person or property proximately caused by a negligent or wrongful act or omission in the operation of any motor vehicle by an employee of the public entity acting within the scope of his employment.” However, liability will typically depend on whether or not the emergency vehicle was in fact responding to an emergency with their lights and sirens on.
Police departments tend to have a great deal of immunity in car accidents when they have their lights and sirens on. When those lights are sirens are not on police officers, firefighters and ambulances are expected to adhere to the rules of the road as would be the case with any other vehicle. These cases can be quite complex and are best examined by an experienced bicycle accident attorney. Victims may be entitled to damages including lost wages, medical bills and pain and suffering.
