Liability In Accidents On Dangerous Roads
According to ASIRT, “Nearly 1.25 million people die in road crashes each year, on average 3,287 deaths a day. An additional 20-50 million are injured or disabled. More than half of all road traffic deaths occur among young adults ages 15-44.” It has been estimated that nearly 94% of accidents involve some amount of human error.
But driver error is not the sole factor behind all accidents. A number of accidents are caused by dangerous roads. State and local governments have a legal responsibility to make sure that their road systems are as safe as reasonably possible. This includes making sure that roads are well designed, constructed and maintained.
According to California Civil Code 835, “Except as provided by statute, a public entity is liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury, that the injury was proximately caused by the dangerous condition, that the dangerous condition created a reasonably foreseeable risk of the kind of injury which was incurred.” There are a number of ways in which a road may be dangerous.
A road could be dangerous if its shoulders are too narrow, if it has blind curves, if the shoulders are unbanked or if the road is poorly grated. When there is a pattern of accidents on a single stretch of road that should put a city on notice that there is a problem that needs to be corrected. If a city fails to correct a dangerous condition on public property and this leads to an accident they may face civil liability.
The family of a victim that dies in a car accident on a dangerous stretch of road may have the ability to file a municipal negligence claim. This can help a victim’s next of kin be fairly compensated for funeral expenses, lost wages, loss of love and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your rights are. There are statute of limitations associated with filing a claim, so it’s important to act quickly.
