Liability In Truck Accidents

A fully loaded semi-trucks can weigh over 10,000 lbs. It is therefore important that truck drivers are following the rules of the road and taking steps to prevent accidents. It is illegal for truck drivers to drink and operate their vehicles. What many people may not realize is that the blood alcohol limit for truck drivers is much lower than for ordinary commuters. The BAC of common drivers in California is 0.08.

According to California Vehicle Code 23152, “It is unlawful for a person who has 0.04 percent or more, by weight, of alcohol in his or her blood to drive a commercial motor vehicle, as defined in Section 15210. In a prosecution under this subdivision, it is a rebuttable presumption that the person had 0.04 percent or more, by weight, of alcohol in his or her blood at the time of driving the vehicle if the person had 0.04 percent or more, by weight, of alcohol in his or her blood at the time of the performance of a chemical test within three hours after the driving.”

Any truck driver that is injured due to the negligence of another truck driver may have the ability to recover damages through a bodily injury claim.
