William King Clayton: 10-Year-Old Boy Injured In Scooter Accident After Being Hit By Car Near Mitchell Canyon Road and Four Oaks Lane
CLAYTON, CALIFORNIA (March 23, 2019) – A 10-year-old boy identified as William King was injured in a scooter accident by the intersection of Mitchell Canyon Road and Four Oaks Lane.
Clayton police are saying that the car accident took place not far from Mt. Diablo Elementary School where William King attends. Witnesses are saying that the intersection where the accident took place is very busy.
The young victim was airlifted to the UCSF Benioff Children’s Hospital in Oakland. The woman who hit William King remained at the scene.
A number of parents are speaking out following the accident “It’s a very dangerous street,” said Amanda Mazza, who is a parent of a child at Mt. Diablo Elementary School.
School officials are looking into measures that can be put in place to make the intersection safer for students. An investigation remains ongoing at this time.
Liability In Scooter Accidents
There may be multiple sources of liability for any car accident or scooter accident. Drivers must obey the rules of the road and operate their vehicles according to the prevailing conditions. According to the California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”
In addition to potential negligence on the part of a driver, there may also be negligence on the part of a city for an accident. Cities such as Clayton have a responsibility to design, create and maintain roads that are reasonably safe. A busy intersection may be dangerous because it lacks basic safety features like signs or because it has an obstructed line of sight. If there are a history of accidents at a particular intersection a city should take measures to correct the problem. Failure to do so may result in civil liability.
Any person that is injured in an accident on a dangerous street may have the ability to seek damages through a personal injury claim. A pedestrian accident can leave victims with lasting injuries including bone fractures, spinal injuries, internal trauma and head injuries. A scooter accident attorney can investigate all of the facts of your case and let you know what your options are.
