CITY OF INDUSTRY, CALIFORNIA (March 23, 2019) – A police officer was injured and had to be hospitalized after a big rig truck driver cut him off by a parking lot on North California Avenue.

City of Industry authorities are saying that the accident took place around 3:20 a.m. A big rig driver made a right turn into a parking lot. A police officer was passing on the right side when the two vehicles collided.

A picture of the car accident showed the police vehicle with major front end damage. Paramedics rushed to the scene and took the injured officer away to the hospital.

A hazmat team responded to the area because the officer’s vehicle began leaking gasoline.

Liability In Truck Accidents

Truck drivers are considered “common carriers” under the law and have a responsibility to operate their vehicles in a very cautious manner to avoid accidents.  According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].”

A number of accidents occur when truck drivers make dangerous right turns or lane changes without checking their blind spots. According to the California Vehicle Code 22107, “No person shall turn a vehicle from a direct course or move right or left upon a roadway until such movement can be made with reasonable safety and then only after the giving of an appropriate signal in the manner provided in this chapter in the event any other vehicle may be affected by the movement.”

A person that is injured in a truck accident may be able to recover damages through a bodily injury claim. Damages may include money for pain and suffering, lost wages and medical bills. Most accident victims will not even fully realize the extent of their injuries until many months after an incident. A truck accident attorney can evaluate all of the facts of your case and let you know what your options are.
