Liability In Train Accidents
Contrary to what a number of people think, there are numerous situations where a train station could be held liable for an accident. For example, train conductors have the same responsibilities as drivers of other commercial vehicles. They must scan the tracks for hazards and apply their brakes in order to avoid hitting pedestrians or vehicles. In addition to using brakes, train operators should also use their horn to warn pedestrians on the tracks about the danger that they are in.
In addition to liability on the part of a train conductor, there may also be liability based on a dangerous condition at a train station. For example, a number of train accidents occur when pedestrians trip due to defects with a walkway near a set of tracks.
