LOST HILLS, CALIFORNIA (October 13, 2018) California Highway Patrol are reporting that a truck accident on the 1-5 Freeway killed Jason Paul and seriously injured his 27-year-old passenger who has been identified as Laura Miller.

The fatal car accident took place by Twisselman Road not far from Lost Hills.  Jason Paul and Laura Miller were first involved in an accident with another vehicle.

Their car became disabled in between two lanes on the highway.  Jason Paul exited the vehicle and walked over to the passenger side of the car in order to help Laura Miller.

While this was happening a semi truck driven by Luis Salgado, Jr. was going southbound on the freeway. He was  unable to avoid their car and hit the left side where Jason Paul was standing.

He died as a result of his injuries and Laura Miller was taken to Kern Medical in order to receive treatment. There was an outpouring of grief on Facebook as news of the fatal accident spread.

“It is heartbreaking! There are not other words,” said Dawnell Meyer.

“I saw this on Michele Hubbard’s fb wall this a.m. it is so terribly sad. When I worked for pdu, Jason was a CPR instructor for a great many annual training classes. He was always so helpful and kind,” said Janet Narum.

“Such a sad thing to happen! I’m heartbroken for his loved ones,” said Sheila Clark Roberts Zinn.

An investigation into the fatal car accident remains ongoing at this time.

What To Do After A Truck Accident

Truck accidents can have devastating consequences not just for an individual but for an entire family. It’s important that victims are proactive in making sure that they’re taking the proper actions to preserve their rights. Here are just a few of the key pieces of information that should be collected after a truck accident:

  • Get the names of all parties involved as well as their contact information.

  • Get the name of the company that the truck driver works for.

  • Get the truck drivers license plate number and vehicle information.

  • Get the insurance information of the truck driver.

  • Seek out any witnesses that may have seen what happened and get their information.

  • Take photos of the aftermath of the collision and of any injuries that you sustained. Also take photos of the road conditions.

  • Do not talk to any insurance adjusters from the truck driver’s company.

  • Seek the legal counsel of an experienced truck accident attorney.

There is one common thread to all of the truck accident cases we’ve handled. Companies will go to extraordinary lengths to deny liability and downplay the extent of a person’s injuries. A personal injury lawyer can take steps to make sure your rights are being preserved.

Liability In Truck Accidents

Depending on a number of factors the truck driver that hit and killed Jason Paul and injured Laura Miller could face civil liability for the crash. Companies that hire truck drivers are responsible for the conduct of those drivers. This is a core concept in personal injury law known as vicarious liability. As long as a company’s employee was working within the course and scope of their employment that company will typically be responsible for their employee’s negligence. In particular, if a truck rear-end a disabled vehicle that is usually a sign that the driver was going too fast or not paying attention. Truck drivers are held to a very high standard and must keep their eyes on the road at all times. There is a presumption of negligence when a truck driver hits a stopped or disabled vehicle. A victim or their family may have legal recourse for their loss by filing a claim for damages.
