Calexico School Bus Accident On Highway 98 Injured Multiple Students And Ford-450 Pickup Truck Driver By Kloke Road

CALEXICO, CALIFORNIA (February 23, 2019) – A Calexico school bus driver is being blamed for an accident that took place in January on Highway 98.

California Highway Patrol are saying that the school bus accident took place around 7:45 a.m. The school bus rear-ended a slow moving pickup truck.  There were around 25 students in the bus at the time of the accident.

Authorities are saying that the school bus driver was going too fast for prevailing conditions before hitting the pickup truck. The female bus driver also had her cell phone in hand and took her eyes off the road in order to change music on the bus.

It was also determined that Bus No. 14 involved in the accident was being driven illegally without a valid certificate. School district officials have declined to comment about the Calexico school bus accident.

Liability In School Bus Accidents

School buses are considered “common carriers” under the law. Drivers are expected to use a high level of vigilance in order to avoid accidents. According to (Acostav. Southern California Rapid Transit Dist. (1970) 2 Cal.3d 19, 27 [84 Cal.Rptr.184, 465 P.2d 72], internal citations omitted.), “Common carriers bind themselves to carry safely those whom they take into their vehicles, and owe both a duty of utmost care and the vigilance of a very cautious person towards their passengers. Such carriers are responsible for any, even the slightest, negligence and are required to do all that human care, vigilance, and foresight reasonably can do under all the circumstances.”

If a school bus driver is negligent and causes an accident the school district that they work for could face vicarious liability. Any person that is injured may be able to recover damages through a bodily injury claim. According to Chambers Medical, “In most cases, people who are involved in a car crash may feel pain, discomfort, and soreness up to 6 weeks after the accident.” Victims may not even realize the full extent of their injuries until months after a collision.
