BRENTWOOD, CALIFORNIA (June 12, 2019) – A 12-year-old boy was critically injured in a skateboarding accident after being hit by car near the intersection of Sand Creek Road and Highland Way.
Brentwood police are saying that the accident took place around 8:00 p.m. The 12-year-old boy that was hit had to be taken to the UCSF Benioff Children’s Hospital Oakland.
He sustained traumatic injuries to his head and the left side of his body. The driver that hit the victim remained at the scene as authorities continued to investigate.
Liability In Pedestrian Accidents
Every driver has a legal responsibility to take measures to avoid hitting pedestrians, even if they are in the middle of the roadway. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” Depending on the facts of any case, a driver may face civil liability if they hit a pedestrian.
It’s important to seek medical attention after an accident and to collect the information of any potential witnesses. A pedestrian accident attorney can examine your case free of cost and let you know what your legal options are. There are, for instance, potential sources of negligence beyond that of the driver. A city could face liability if it was caused by a dangerous condition in the roadway.
