Liability In Pedestrian Accidents
It has been estimated that nearly 94% of all pedestrian accidents are due to human error. Drivers often fail to yield the right of way to pedestrians in lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.”
Most pedestrian accidents tend to happen between the hours of 6:00 p.m. to 9:00 p.m. The family of any victims that died in a pedestrian accident will typically have recourse through a wrongful death claim. Damages can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can investigate all of the facts of your case free of cost and get to the bottom of what happened.
