BERKELEY, CALIFORNIA (June 2, 2019) – A 36-year-old woman from North Hollywood identified as Luvette Monarque died in a car accident with a speeding Tesla by the intersection of Haste Street and Fulton Street.
The fatal car accident took place in downtown Berkeley on Friday night around 11:47 p.m. A man speeding in a Tesla hit a Ford Fiesta carrying Luvette Monarque and her sister. The Tesla driver then hit a white Dodge pick-up that was heading westbound.
The Ford Fiesta caught fire and trapped the victims inside. Despite life-saving efforts, Luvette Monarque died of her injuries at the hospital and her 32-year-old sister remains in critical condition.
Neither drugs nor alcohol are believed to have been factors in the crash. The intersection of Haste Street and Fulton Street was closed for over 12 hours as Berkeley police investigated.
There were a total of five people inside the Tesla at the time of the crash. One person required hospitalization. A full investigation into the cause of the accident remains ongoing at this time.

Causes of Accidents Involving Tesla Cars
Tesla cars are electric vehicles that have become increasingly popular across the country and throughout LA and the Bay Area. Unlike gasoline cars, Tesla have instant torque due to their electric motors. This allows the cars to accelerate quickly. Unfortunately, a number of younger and more inexperienced drivers have been irresponsible with many of these features.
There have also been a number of fatal accidents involving Tesla vehicles in ‘autopilot.’ Simply put, autopilot is a driver assistance program that handles the breaking and acceleration in highway traffic. Think of it as ‘smart cruise control.’ Tesla Inc. has been hit with a number of lawsuits after accidents caused by alleged autopilot malfunctions. Any accident involving a Tesla vehicle could potentially involve multiple forms of liability beyond driver negligence.
Liability In Tesla Accidents
Every driver in California has a legal responsibility to operate their vehicle in a reasonably safe manner and take steps to avoid accidents. Despite this, speeding is one of the leading factors of fatal vehicle collisions. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”
Any driver that causes an accident due to reckless speeding may potentially face civil as well as criminal liability. But driver error is not the only source of potential negligence in a car accident involving a Tesla. Many of the newer model Tesla vehicles are equipped with automatic breaking. The car is supposed to stop (or at the very least decelerate) if it senses an impact. Tesla could face civil liability if this system or autopilot malfunctions or contributes to an accident.
Any person that is injured in a car accident with a Tesla – or their family – may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help victims recover for medical expenses, lost wages, pain and suffering and emotional trauma. A car accident attorney can investigate all of the facts of your case free of cost and let you know what your legal options are. There are, however, statute of limitations associated with being able to file a claim, so it’s important to act quickly.
