Liability In Pedestrian Accidents
Drivers have a responsibility to keep an eye out for pedestrians and yield the right of way when necessary. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” Most pedestrian accidents tend to take place between 6:00 p.m. to 9:00 p.m. as drivers are heading home from work.
Any pedestrian that is injured in an accident may be able to recover damages through a bodily injury claim. Many of the damages associated with a car accident can be long lasting. Some can be psychological and thus invisible to the naked eye. For example, at least 9% of people involved in car accidents developed post-traumatic stress disorder (PTSD). A pedestrian accident attorney can investigate your claim and let you know what your options are.
