Animal control officials have been able to capture all of the dogs. It remains unclear if they will all be euthanized.
In the meantime Bakersfield police are asking anyone that may have seen the fatal dog attack in the Costco parking lot to reach out to them.
Liability In Dog Attacks
Dog owners are held strictly liable for attacks involving their animals. According to California Civil Code 3342, “The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness.” As indicated in the statute, it doesn’t matter if this was the first time that an animal has ever shown aggression.
Depending on the facts of any case, liability may extend beyond the owner of a dog. For example, a Costco could be liable for a dog attack that happened on their premises. Companies are responsible for maintaining their premises in a reasonably safe manner. If their are loose dogs rooming the parking lot animal control should be called so that they can be taken away.
The family of any victim that died in a dog attack may have legal recourse under California Code of Civil Procedure 377.60. Damages in a civil claim may include compensation for lost wages, medical bills and pain and suffering. A dog bite injury attorney can examine all of the facts of your case and let you know what your legal options are. An attorney can take steps to make sure that evidence is being preserved and that your rights are being protected.
