Liability In Forklift Accidents

Forklifts can be a tremendously useful tool in a variety of settings. OSHA has estimated that there are around 1 million forklifts in use across the United States. However, forklifts present a number of unique hazards not associated with other equipment. Here are just a few of the accidents that employers should work hard to prevent.

  • Rollovers often leave workers with serious injuries and may result in death. Wearing a seatbelt can prevent a number of deaths. Most accidents take place when the forklift is going up or down an incline. The driver can be thrown out and pinned by the overhead guard.

  • A number of accidents occur when a forklift is being operated at an unsafe speed. Forklifts are incredibly heavy and therefore carry a lot of momentum. It can be difficult to stop them and if a person is hit they can be seriously injured.

  • Ensuring load stability is an important way to prevent forklift accidents. Forklifts routinely lower and raise very heavy loads. A number of workers are seriously injured or killed every year when they are hit by falling loads.

When a worker is injured or killed by a forklift they or their family may be able to receive workers compensation. Depending on the facts of any case, a worker or their family may be able to file a third party negligence claim. This may be possible if a forklift malfunctioned and this caused an accident. A number of product liability claims are filed every year against forklift manufacturers. If a company separate from a worker’s employer causes an accident that company could face civil liability.

It’s important to seek the advice of an experienced wrongful death attorney after a forklift accident. An attorney can investigate your case and let you know what your options are. A victim’s family may be entitled to damages including lost wages, medical bills and pain and suffering. There are very strict statute of limitations associated with filing a claim, so it’s important to act quickly.
