BAKERSFIELD, CALIFORNIA (January 14, 2019) – A 42-year-old construction worker identified as Brien James Daunt has tragically died in a fall at the new Amazon Fulfillment Center in Oildale.
Investigators are saying that the accident happened around 3:00 p.m. on Saturday off Petrol Road near Meadows Field Airport. Firefighters and paramedics rushed to the scene of the fall in order to help Brien James Daunt.
Despite lifesaving efforts he later died as a result of his injuries. It remains uncertain if crews will keep working to finish the Amazon fulfillment center during the investigation.
Liability In Construction Accidents
Construction workers in California are protected by a number of laws. Companies are responsible for purchasing worker’s compensation insurance. Victim’s or their family are able to access this in the event of an accident. Depending on the facts of any case, the family of a deceased worker may have the ability to file a third-party negligence claim. In short, if an entity separate from a worker’s employer caused an accident that company could face civil liability.
Generally speaking, construction sites are made up of a blend of different companies that must work together. If there are safety violations at a work-site, the company responsible for keeping the site safe may potentially be held liable. One of the easiest ways to prevent construction falls is for companies to install safety perimeters and give workers fall arrest systems. A wrongful death attorney can evaluate the specific facts of your case and let you know what your rights are.
