Liability In Truck Accidents
Truck drivers have a legal responsibility to operate their vehicles in a reasonably safe manner and take steps to avoid accidents. If a truck driver crosses a double yellow line or a center median they are likely to be found at fault in the event of an accident. According to California Vehicle Code 21460, “If double parallel solid yellow lines are in place, a person driving a vehicle shall not drive to the left of the lines, except as permitted in this section.” Here are just a few of the most common reasons why a truck driver might cross over a center median:
- Brake problems
- Traffic flow interruption (congestion, previous crash)
- Prescription drug use
- Traveling too fast for conditions
- Unfamiliarity with roadway
- Roadway problems
- Required to stop before crash (traffic control device, crosswalk)
- Over-the-counter drug use
- Inadequate surveillance
A fully loaded semi-truck can weigh as much as 80,000 lbs. Any person that is injured in a truck accident with a negligent driver may have the right to damages through a bodily injury claim. Most trucks have at least $1,000,000 worth of liability coverage. This can help with lost wages, medical bills and pain and suffering. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
