Causes of Truck Accidents
According to the Federal Motor Carrier Safety Administration, nearly 35,000 people are killed every year in the United States as a result of car accidents. Those that manage to survive are often left with serious and debilitating injuries. There are hundreds of different factors associated with commercial truck accidents. But ten factors in particular are behind the vast majority of collisions. These may include:
- Brake problems
- Traffic flow interruption (congestion, previous crash)
- Prescription drug use
- Traveling too fast for conditions
- Unfamiliarity with roadway
- Roadway problems
- Required to stop before crash (traffic control device, crosswalk)
- Over-the-counter drug use
- Inadequate surveillance
In many accidents, alcohol/drug use was listed as the major contributing factor. For truck drivers, fatigue is the biggest problem. Truck drivers are required to get adequate sleep and are limited in the number of hours that they can work. But this does not always happen. Depending on the facts of any case, there may be numerous sources of liability for a truck accident.
Liability For Truck Accidents
Truck drivers are held to a very high standard when it comes to safety. They must attempt to see and avoid potential sources of danger. A number of accidents take place when pedestrians are hit after they have been involved in a previous accident. If a truck driver was negligent and hits a pedestrian they or the company they work for could face civil liability. In general, many truck drivers are listed as independent contractors, but they are still required to carry commercial insurance policies.
Determining liability in a pedestrian accident close to the freeway can be very difficult. Most commercial trucks have event data recorders (EDRs). These devices function in much the same way that the “black box’ on an airplane does. An event data recorder can help determine:
- If a truck driver used their brakes before an accident
- How fast the truck was going before an accident
- Maintenance that has been performed on the vehicle
A truck accident attorney can investigate all of the facts of your case and get to the bottom of what happened. The family of a victim that died in a truck accident may be able to seek justice through California’s Code of Civil Procedure 377.60. Damages may include compensation for funeral expenses, loss of love and lost wages. An attorney can examine your case free of cost and let you know what your legal options are.
