Construction Worker Died In Bobcat Tractor Accident At Arden Arcade Apartment Near Morse Avenue and Arden Way In Sacramento

ARDEN ARCADE, CALIFORNIA (March 27, 2019) – A construction worker has tragically died at an apartment complex located on Morse Avenue near Arden Way in Sacramento.

Arden Arcade authorities are saying that a worker was injured while he was operating a Bobcat tractor. The worker somehow was crushed in between the bucket and the vehicle.

Another worker found the injured man and immediately called for help. Cal/OSHA as well as the Sacramento County Coroner’s Office are now investigating.

It remains unclear if the Bobcat tractor may have malfunctioned.

Safety Issues With Bobcat Tractors

Excavators, backhoes and tractors are all commonly used in construction projects. They make moving dirt or other objects around much easier. But these equipment can also be dangerous if they are not used properly or if they malfunction. Bobcat tractors in particular can be top heavy and are prone to tipping over. If a driver is not buckled in correctly they can be ejected and run over.

The top of the Bobcat tractor is operated through a hydraulic pump. If this arm malfunctions it can close down and crush a worker. It’s important that companies take steps to make sure that their equipment are periodically checked. Construction workers should also be properly trained to use heavy equipment. There are a number of potential sources of liability if a worker is injured or killed on the job.

Liability In Construction Accidents

Every company in California must purchase worker’s compensation insurance to protect their worker’s in the event of injury or death. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” This includes providing benefits to a worker’s next of kin or other dependents. According to OSHA, there are four major accident types that make up roughly 60% of all workplace injuries and deaths:

  • Falls
  • Struck By Objects
  • Electrocutions
  • Caught In Between Accidents

OSHA has set forth a number of machine and machine guarding general requirements. When these are not followed accidents tend to occur. In addition to worker’s compensation the family of an injured worker may have the ability to seek justice under California’s Code of Civil Procedure 377.60. In short, worker’s are not allowed to bring claims directly against their employer, but the family of a worker could seek damages through a third party liability claim.

A third party liability claim may be possible if a worker was injured by a piece of faulty machinery. A wrongful death attorney can examine all of the facts of your case and let you know what your rights are. There are statute of limitations associated with being able to pursue a claim, so it’s important to act quickly.
