Liability In DUI Accidents
Drinking and driving is an epidemic in the United States. It is one of the leading factors behind fatal crashes. Drug use behind the wheel is also a major problem. According to Mothers Against Drunk Driving (MADD), “About 4,000 drivers are killed each year with drugs in their systems. This doesn’t count those who had drugs in their system without test results, or those killed by drivers with drugs in their system.” Drivers that use drugs or alcohol and cause accidents will likely face civil as well as criminal liability.
According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” The family of a victim that dies in a DUI accident may be able to seek justice through a wrongful death action.
