Motorcyclist Injured In Aptos Power Line Accident On Highway 1 Between Freedom Boulevard and Rio Del Mar

APTOS, CALIFORNIA (July 2, 2019) – A motorcyclist on a Zero electric motorcycle was seriously injured when he was clotheslined by a downed power line by Freedom Boulevard and Rio Del Mar.

California Highway Patrol are saying that the motorcycle accident took place around 2:15 p.m. The powerline was draped across the freeway after it was pulled down by a falling tree.

The powerline hit the victim’s helmet and pulled him down. He was taken via air ambulance to the Dominican Hospital. Aptos police are saying that he received serious injuries to his throat, neck and face.

Pacific Gas and Electric was called to the scene of the accident in order to remove the downed power line. An image of the scene showed the downed oak tree and power line.

An investigation into the motorcycle accident remains ongoing at this time.

Liability In Motorcycle Accidents

According to the Insurance Information Institute, “Motorcycles are by their nature far less crashworthy than closed vehicles. They are also less visible to other drivers and pedestrians and less stable than four-wheel vehicles. Operating a motorcycle requires a different combination of physical and mental skills than those used in driving four-wheel vehicles.” It has been estimated that nearly 94% of all accidents are caused by human error.

But driver error is not always the cause of motorcycle accidents. A number of motorcyclists are seriously injured or killed every year by debris in the roadway or fallen objects. Depending on the circumstances of any case, there may be multiple forms of liability for an accident caused by a downed power line. For example, cities have a legal responsibility to conduct periodic inspections on trees to make sure that they are in a reasonably safe condition.

Trees that show signs that they may fall over due to decay should be promptly removed. Far from being a freak occurrence, falling trees are the predictable outcome when those trees are poorly maintained. Any person that is injured in an accident with a falling tree may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A motorcycle accident attorney can examine all of the facts of your case free of cost and let you know what your legal options are.
